Terms and Conditions of the Online Shop (GTC)

1. General

The online shop on the website https://www.skincode.com (the “Online Shop”) is an online shopping service by Skincode AG for customers in Switzerland, Europe, and beyond.

To place an order on this site, you must be a natural person, 18 years of age or older, and have full legal capacity. By ordering a product on the Website, you agree that you have read and fully accepted these General Terms and Conditions of Sale (“GTC”).

Any industrial or commercial use for the purpose of reselling goods to third parties is strictly prohibited. Such violations will lead to the immediate cancellation of the order. In such a case, Skincode AG reserves the right to claim damages and to take any other action provided for by law or regulatory act.

2. Orders, prices, payment terms, VAT, etc.

2.1 Formation of contract

The Online Shop and the product descriptions therein constitute an invitation to make offers (to place an order). The Online Shop and product descriptions do not contain legally binding offers from Skincode. By placing an order, you submit an offer to purchase products from Skincode. Skincode is free to accept or reject your offer. With the sending of our confirmation email, the order becomes binding. As a rule, on working days, a confirmation email is sent within 24 hours of receipt of your order.

2.2 Products

All products in the Online Shop are subject to availability. Skincode AG reserves the right to add and remove any product from the Online Shop at any time. In the event that an ordered product is not available, our Customer Service will contact you by email as soon as possible, and we will immediately refund any payment already received from you in connection with the unavailable product.

If we reject your offer, we will immediately refund any payment already received from you in connection with the rejected order. We also reserve the right to limit the maximum delivery quantity per item and per customer. In such a case, and if we have already received payment from you, we will refund the excess amount.

2.3 Prices

The prices applicable to your order are those on the site at the time of your order. The information contained in this Online Shop may contain technical inaccuracies or typographical errors. Any liability of Skincode, however arising, for such inaccuracies or errors is expressly excluded to the maximum extent permitted by law. We also reserve the right to change our prices at any time without prior notice, but such changes will not affect your orders accepted prior to these modifications.

All prices are net prices, including Swiss VAT. Taxes, customs duties, and shipping fees are not included in the prices and may apply to orders outside Switzerland. See Shipping

You are responsible for paying fees and commissions related to credit card payments linked to bank accounts outside the Eurozone.

2.5 Payment

Payment must be made immediately upon placing the order. The following payment options are offered: Master Card, Visa, and American Express. All payments are handled by Stripe or PayPal. Data is encrypted and transmitted to the relevant institution for processing.

3. Shipping. Delivery areas, delivery times, etc.

3.1 General

We ship to Switzerland and other selected countries. Products will be delivered to the address indicated in the order confirmation. As a rule, the order will be delivered within 3-12 working days. For more information, see Shipping.

3.2 Shipping costs

We offer free shipping for all orders within Switzerland. For other countries, see Shipping

3.3 Wrong, incomplete or damaged orders

We apologize for any inconvenience caused by wrong or damaged deliveries. If you receive a wrong, incomplete or damaged order, please contact us within 48 hours of receipt of the goods. Provide us with your order number and photos of the received package for our team to assess the situation. We will send a new package replacing the defective or missing items, at no cost.

3.4 Returns

You can return ordered products within 14 days of receiving the products, for any reason and without justification. We do not accept returns of products that have been opened or whose seal has been removed. The return must be notified to us in writing (i.e., by email or regular mail) to the following address. The costs of returning the products are borne by you. This right of return does not limit any statutory right of revocation you may have under applicable consumer protection legislation.

3.5 Storage

Products should be stored in a dry environment, between 10-25°C, avoiding direct sunlight.

3.6 Warranty

We highly value you as our customer and are proud to offer you quality products. Our products undergo a quality assurance test as part of the manufacturing. However, errors do occur. If you receive a defective product, we will replace it in accordance with point 3.3 above. Our warranty is two years from the order date. All other warranty rights are excluded as far as legally possible.

All other statements or warranties regarding the products, whether express or implied, are expressly excluded.

4. Data protection and privacy

The protection of our customers' data and privacy is very important. We do not share your personal data with third parties without your consent. Exceptions are data necessary for the execution of orders, for payment processing and monitoring, for credit checks, and for evaluating the use of our website (web analytics). All personal information you provide us (name, surname, residential address, delivery address, email address, phone number, and purchases) will be treated as strictly confidential. We may use your personal data to contact you for marketing purposes, but only if you give consent for us to use your data for specific marketing purposes by clicking the appropriate box.

5. Liability

We are liable for any damage to your health in the event that it is caused by our negligence or intent.

We are also liable for other damages if these are the result of our gross negligence or intent.

Any other liability is excluded. This exclusion of liability does not limit any extra-contractual liability arising from applicable product safety laws.

6. Applicable law and jurisdiction

The purchase agreement is governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

The courts of Zurich, Switzerland, have exclusive jurisdiction in relation to any dispute arising out of or in connection with this purchase agreement, unless otherwise required by mandatory national or international laws or treaties.

7. Extraordinary unforeseeable circumstances

Unforeseeable and extraordinary circumstances may, in individual cases, have a negative impact on our ability to fulfill our agreement. For example, national COVID-19 regulations may prevent Skincode, in individual cases, from delivering orders. In such a case, Skincode has the right to postpone or cancel the order. In the event of an order cancellation, you will be fully refunded for the payment received by us in connection with the order. Skincode's Terms and Conditions apply in all other parts.

8. Modification of these General Terms and Conditions of Sale

Skincode AG has the right to update these General Terms and Conditions of Sale at any time without notice. The version of the General Terms and Conditions that was valid at the time of your purchase, and that you accepted during the checkout process, is the applicable version in the context of the specific purchase agreement concluded with our acceptance of your offer.

7. Invalid provision

If any provision of these Terms of Use is or becomes invalid, this invalidity will have no effect on the validity of the other provisions of these Terms of Use.
